Please be aware of the North Carolina statute of limitations in personal injury cases. The statute for any personal injury caused by the negligence of another is three years from the date of injury and that includes medical malpractice. The time limitation for filing a lawsuit in a wrongful death case, however, is only two years from the date of death.
