Sedimentation and Erosion Control:
Uncontrolled soil erosion is a major concern in Western North Carolina. If proper erosion control measures are not taken, runoff to adjoining property or into streams can cause serious damage. North Carolina has a unique statute that enables property owners to seek relief from soil erosion caused by an adjoining property owner. Under the North Carolina Sedimentation Pollution Control Act, a person injured by a land-disturbing activity that is a violation of the North Carolina Sedimentation Pollution Control Act or a local ordinance may seek injunctive relief, an order enforcing the law, rule, ordinance or plan that the adjoining property owner violated and/or damages caused by the violation. If the court or jury determines that the injured party's actual damages are five thousand dollars ($5,000) or less, the court will award the injured party with the costs of litigation including reasonable attorneys fees and expert witness fees.
