Environmental Law:

Environmental issues significantly impact individuals and corporations. Our Asheville lawyers provide counsel to clients in land preservation and conservation. We also represent clients in environmental litigation and administrative matters.

Sedimentation and Erosion Control:

Uncontrolled soil erosion is a major concern in Western North Carolina. If proper erosion control measures are not taken, runoff to adjoining property or into streams can cause serious damage. North Carolina has a unique statute that enables property owners to seek relief from soil erosion caused by an adjoining property owner. Under the North Carolina Sedimentation Pollution Control Act, a person injured by a land-disturbing activity that is a violation of the North Carolina Sedimentation Pollution Control Act or a local ordinance may seek injunctive relief, an order enforcing the law, rule, ordinance or plan that the adjoining property owner violated and/or damages caused by the violation. If the court or jury determines that the injured party's actual damages are five thousand dollars ($5,000) or less, the court will award the injured party with the costs of litigation including reasonable attorneys fees and expert witness fees. Our firm has experience in litigation involving the North Carolina Sedimentation Pollution Control Act.
