ASSOCIATION CLIENTS: There have been recent changes to the North Carolina Condominium Act and the North Carolina Planned Community Act to ensure that associations have the current mailing addresses for owners.

These changes are EFFECTIVE OCTOBER 1, 2009.


  1. Prior to filing a claim of lien, the association must make reasonable and diligent efforts to ensure that the Association's records contain the lot owner's current mailing address.

  2. Statement of amount due must be mailed by first-class mail 15 days prior to filing the lien (Please ask our firm about the additional requirements for the "required 15 day letter").

  3. The Statement of amount due must be mailed to:

    1. Physical address of the Lot,

    2. Lot owner's address of record with the Association, and if different,

    3. The address shown on County Tax Records and County Real Property Records.

    4. If the lot owner is a corporation, the statement shall also be sent by first-class mail to the mailing address of the registered agent for the corporation.
